1. Service overview

Vanessa (accessible via vanessacall.com) is a voice conversation service with a conversational agent powered by artificial intelligence. The service is operated by EDXAD LLC, a company registered in the United States.

2. Access to the service

This service is strictly reserved for adults (18 years and older). By using this service, you confirm that you have the legal age required in your jurisdiction.

Using the service implies full and complete acceptance of these terms.

3. Nature of the service

Vanessa is a virtual character generated by artificial intelligence. All conversations take place with an automated agent, not with a real person. The photographs shown are images generated by artificial intelligence and do not represent any real person.

4. Pricing

The service operates on a per-minute billing model, at a rate of €1 incl. tax per started minute. Any minute started is owed in full (rounded up to the next minute).

• No subscription is required.
• The user may end the call at any time.
• The payment method is retained by our payment provider to allow billing at the end of the call as well as any subsequent call initiated via the "Call again" feature.

5. Payment and authorization to charge

Payments are processed by a PCI-DSS certified payment provider. No complete banking data is stored on our servers.

On your bank statement, the transaction will appear with the descriptor VANESSACALL.COM.

By registering your card and starting a call, you expressly authorize vanessacall.com to charge that card the amount corresponding to the call duration, without further input from you. This authorization remains valid for any subsequent call initiated from the same device via the "Call again" feature, as long as you have not requested the removal of your payment method.

6. Funding, payment failure and unpaid charges

The user agrees to maintain sufficient funds on the registered card for the duration of the call, and not to block or oppose the card with the intention of avoiding the charge.

If a charge is declined for any reason whatsoever (insufficient funds, opposition, card block, expiration, limit reached, etc.):

• The amount corresponding to the minutes consumed remains fully due.
• vanessacall.com reserves the right to retry the charge, at reasonable intervals, until settlement.
• Access to the "Call again" feature may be suspended until the debt is settled.
• vanessacall.com reserves the right to engage any amicable or judicial recovery procedure, and where applicable to transfer the file to a specialized provider, with the corresponding costs being borne by the defaulting user.

Any payment dispute (chargeback) made after the service has been delivered, without legitimate cause, may be contested with our payment provider and, where applicable, lead to a fraud complaint (article 313-1 of the French Criminal Code, or equivalent in the user's jurisdiction).

7. No right of withdrawal and non-refundable

In accordance with article L221-28 of the French Consumer Code, the voice conversation service being fully performed upon pickup and consumed in real time by the user, the right of withdrawal does not apply.

Calls performed are non-refundable. Only manifestly erroneous charges (technical issue proven to have prevented the service from functioning) may be refunded, upon motivated request sent to the contact address.

8. Intellectual property

All content of the service (text, voice, AI-generated photographs, code, design) is the exclusive property of EDXAD LLC or its licensors.

The photographs accessible during the call are provided for personal and private use only. Any reproduction, distribution, sharing, downloading, screen capture for redistribution purposes, or commercial use is strictly prohibited and constitutes an infringement of intellectual property rights.

Any unauthorized redistribution may result in legal action.

9. User conduct and prohibited uses

Use of the service is strictly limited to personal, private and lawful use between consenting adults. The user agrees to comply with these terms as well as all laws applicable in their jurisdiction.

Expressly prohibited, without this list being exhaustive:

• Any content, suggestion or scenario involving minors, real or fictional, including any reference to a character presented as being under 18 (child sexual abuse material, sexualization of minors, grooming).
• Any content involving animals in a sexual context (bestiality).
• Any content involving non-consensual acts, rape, torture, human trafficking or sexual slavery.
• Any content involving incest between members of the same family.
• Any content involving acts of extreme violence, mutilation, or necrophilia.
• Any attempt to make the conversational agent produce content falling within the categories above, through bypass, manipulation or disguised role-play.
• Use of the service from a jurisdiction where such a service is illegal.
• The recording, capturing, rebroadcasting, sharing or publication of any content from the service (audio, images) without prior written authorization.
• Any attempt to circumvent technical protection measures (anti-screenshot, anti-download, watermarking).
• Harassment, abuse, or attempts at malicious manipulation of the system.
• Use of the service on behalf of a third party or resale, in any form whatsoever.

Any behavior contravening the prohibitions above results in the immediate termination of access to the service, without refund. Content amounting to criminal offenses (in particular involving minors or non-consensual acts) will be reported without delay to the competent authorities, including the National Center for Missing & Exploited Children (NCMEC) and the police services of the relevant jurisdiction, in accordance with applicable legal obligations.

10. Limitation of liability

The service is provided "as is". EDXAD LLC does not guarantee uninterrupted availability. In the event of technical unavailability during a call, billing is suspended.

Vanessa is a conversational agent for entertainment purposes. The service has no therapeutic, medical, legal or financial vocation. No advice given by the agent shall engage the responsibility of the publisher.

11. Applicable law

These terms are governed by the law applicable at the registered office of EDXAD LLC. Any dispute will be submitted to the competent courts.
